The Delhi Supreme Court has barred several rogue websites from using the Amazon online marketplace trademark and its logos or a deceptive variant identical to the original brand, noting that the activities of these sites result in financial harm to the innocent audience.
The Supreme Court said it believed the plaintiffs, Amazon Seller Services Private Limited and its other companies, made a prima facie case for an ex parte ad interim injunction.
“The balance of convenience is in favor of the plaintiffs and they are likely to suffer irreparable harm if the injunction, as requested, is not granted. In addition, the activities of the rogue defendants result in a financial loss to the innocent and unsuspecting members of the public,” said Judge Jyoti Singh.

It has also instructed the Ministry of Telecommunications and the Ministry of Electronics and Information Technology to issue notices urging the various Internet and telecom service providers registered under it to restrict access to the various websites or rogue suspects identified by the plaintiffs. to block.
The Supreme Court’s preliminary injunction came during the hearing of a lawsuit filed by Amazon Sellers Services Private Limited and its affiliates, alleging that the rogue defendants were involved in a pre-planned conspiracy to defraud and defraud innocent people through make unauthorized and illegal use of the Plaintiffs’ characters, on the fraudulent websites and social media pages operated by them or as part of the domain name they have registered.
Amazon argued that the rogue defendants are blatantly reproducing the content of the plaintiffs’ website adopting a look-and-feel identical to their original website “www.amazon.in” and that they are involved in these infringing and deceptive activities. to defraud innocent people interested in registering as ‘Amazon Easy Store’.
