The Supreme Court of Allahabad has remained of a final judgment or order in the consolidated process of the forced deportation case 2016, in which twelve previously separated FIRs are involved against ex-MP Mohammad Azam Khan and various others.
Justice Dineh Pathak commissioned to set up this case as fresh on July 3, but clarified that the process would take place in the case. However, no final order would be adopted until July 3, 2025.
The court gave the order in an application submitted by co-fertilized Mohammad Islam aka Islam Thekedar and another.
In the present case, which came from 12 FIRs who were registered at the Kotwali police station between 2019 and 2020, the Rampur district relates to an alleged incident on 15 October 2016, where the demolition of unauthorized structures on the WAQF-Ownership is known as Yateeem Khana, Waqf No-157.
These FIRs, initially as individual cases, were consolidated in Rampur on 8 August 2024 by the special judge (MP/MLA).
The decision of the current Supreme Court of 11 June came after the counsel of the applicants emphasized the determination of the court to close the trial in June, increasing the fear of procedural fairness.
Justice Pathak acknowledged the “peculiar facts and circumstances” and ruled that although the process can continue, no definitive order is adopted until the next hearing on July 3, 2025.
In a related development, a petition of former Uttar Pradesh Minister and EX-MP Azam Khan and his assistant Virendra Goel has been established on 18 June as a 'mentioned case' for a single judge of the Supreme Court.
The court challenges this petition on 30 May 2025, orders their requests to reject informants and important witnesses of the persecution, including Zafar Ahmad FarooQui, chairman of the Sunni Central Waqf Board, and to produce exculpation video proof of the Eviction 2016.
The applicants claim that this evidence, recognized by Mr. Farooqui, could free them by proving their absence of the scene.
