This is a complex and sensitive issue, the Supreme Court had said:
New Delhi:
A court in Varanasi will decide today whether to hear the Hindu petitioners’ plea to appeal the Gyanvapi Mosque film report or the Muslim side’s case that the subpoena is unenforceable.
The Supreme Court, hearing a petition challenging the shooting of Gyanvapi Mosque in Varanasi, said Friday that the case would be heard by an experienced judge in Uttar Pradesh.
The Supreme Court had also emphasized that “the need for community fraternity and the need for peace is paramount” before the court.
Early last week, lawyers for Hindu petitioners claimed that a ‘Shivling’ had been found during the videographic search of the Gyanvapi Mosque-Shringar Gauri complex. The claim was disputed by the mosque committee members, who said it was part of the water fountain mechanism in the wazookhana reservoir, which is used by devotees to perform ritual ablutions before offering namaz. The court had then ordered the sealing of the ‘wazookhana’.
The Supreme Court on Tuesday ordered the Varanasi court to ensure protection of the area where the ‘Shivling’ was said to have been found, but without hindering “religious celebrations”.
