In a statement her lawyers sent to DailyExpertNews on Tuesday, Anna Palus accused Kyrgios of making the allegation, which she described as “reckless and completely unfounded,” and which she said caused “significant harm and suffering” to her and her family. .
“I am not litigating, but after much consideration I have come to the conclusion that I have no choice but to instruct my attorneys Brett Wilson LLP to initiate defamation proceedings against Mr Kyrgios to clear my name” , the statement read.
“The need to obtain justification and prevent a repetition of the accusation are the only reasons for taking legal action. All damages recovered will be donated to charity.”
She added: “I hope Mr Kyrgios will reflect on the damage he has caused me and my family and provide a swift resolution to this matter.
“But if he doesn’t want to do this, I’m committed to going to the Supreme Court.”
Kyrgios, who was eventually defeated in the match by Novak Djokovic that day, had become angry during the match after saying there was noise from the crowd.
He then expressed his anger at the seat umpire and asked for the fan to be evicted from the stadium because he was constantly talking to him during a match.
“She’s drunk, so kick her out,” he said.
When asked by the umpire which supporter it was, Kyrgios gestured to the stands and said, “The one who looks like she’s had about 700 drinks.”
Palus says she was temporarily removed from the arena as a result.
“During the final, Nick Kyrgios made a reckless and completely baseless accusation against me,” Palus said in her statement.
“Not only did this cause significant damage on the day, resulting in my temporary removal from the arena, but Mr Kyrgios’ false accusation was broadcast to and read by millions around the world, causing very significant harm to me and my family and caused suffering.”
DailyExpertNews Sport has reached out to Kyrgios’ legal team for comment, but has not yet received a response.
The 27-year-old will play this year’s US Open, which runs from August 29 to September 11.
