The Supreme Court today accepted a petition by AAP MP Raghav Chadha challenging his suspension from Rajya Sabha for allegedly forging signatures of MPs.
The court has sought response from the Rajya Sabha Secretariat and also sought the assistance of the Attorney General of India in the matter. The case will be heard further on October 30.
Hearing the case, Chief Justice of India DY Chandrachud said the court needs to know whether a member can be suspended from Rajya Sabha when an investigation against the MP is pending.
Chadha was suspended in August after four MPs alleged he appointed them to a House panel without their consent. The House of Representatives has passed a resolution moved by House of Representatives leader Piyush Goyal to suspend Mr Chadha until the privilege committee submits its findings in the case.
Mr Goyal termed the AAP leader’s conduct in the House of Representatives as “unethical” and a “scandalous disregard of the rules”.
