Anti-corruption ombudsman Lokpal on Tuesday directed the CBI to probe the cash-for-query allegations against Trinamool Congress (TMC) leader Mahua Moitra and submit the findings to the CBI within six months, according to an order.
Ms Moitra was expelled from the Lok Sabha in December last year for “unethical conduct”, prompting the Supreme Court to challenge her expulsion. She has been nominated by the party as its candidate from Krishnanagar Lok Sabha seat in West Bengal.
The Lokpal directive came while hearing a complaint by BJP Lok Sabha member Nishikant Dubey, alleging that Moitra had asked questions in the House in return for cash and gifts from Dubai-based businessman Darshan Hiranandani.
“After careful evaluation and consideration of all available material, there remains no doubt that the allegations against the RPS (Respondent Public Servant), most of which are supported by compelling evidence, are extremely serious in nature, especially in view of the position she occupies,” reads the Lokpal order.
The order names Ms Moitra as the RPS.
“Therefore, in our considered opinion, a deeper investigation is required to determine the truth. This is vital in view of the position and status occupied by the RPS at the relevant time,” the order of the Lokpal bench comprising Justice Abhilasha said. Kumari (judicial member) and members Archana Ramasundaram and Mahender Singh.
Whatever the position, a public servant is obliged to exercise honesty in the performance of his or her duties.
“The responsibility and burden rests more heavily on the shoulders of a public representative. Corruption is a malaise that adversely affects the legislative, administrative, social and economic functioning of this democratic country,” the order said.
“It is a duty incumbent upon us and, indeed, the mandate of the (Lokpal) Act, that all efforts are made to eradicate corruption and corrupt practices that affect aspects such as undue advantage, illegal gain or advantage and consideration under their purview to take. pro quo in the performance of public duties,” the report said.
Accordingly, “we direct the CBI to investigate all aspects of the allegations contained in the complaint and submit a copy of the investigation report within a period of six months from the date of receipt of this order,” the order said.
The CBI will also submit periodic reports on the status of investigation every month, it added.
