New Delhi:
The Supreme Court today quashed the Gujarat government's decision to release the 11 convicts who raped Bilkis Bano and murdered her family during the 2002 Gujarat riots.
Here are the key observations from the Supreme Court's judgment in the Bilkis Bano case:
While Bilkis Bano's plea challenged the waiver as maintainable, a bench of Justices BV Nagarathna and Ujjal Bhuyan said the Gujarat government was not the appropriate government to pass the waiver order.
The Gujarat government should have filed a plea seeking review of the 2022 order stating that they are not the competent government.
The court said that the rights of the victim are important and that women deserve respect.
The court said the May 2022 Supreme Court order was obtained through fraudulent means and suspension of facts.
“By suppressing material facts and presenting misleading facts, a convict has directed the State of Gujarat to consider remission. There was no direction from this court to the Government of Gujarat to consider remission. This is an act of fraud,” the court said. said.
